Adult Out of Court Resolution (OoCR) Scrutiny Panel Findings- July 2026 9 cases scrutinised = 3 cases per area (Cardiff and the Vale, Mid Glamorgan, Swansea and Neath Port Talbot) Some inconsistencies were identified in the use of Conditional Cautions (CCs) and Community Resolutions (CRs), highlighting a need for greater clarity and consistency. Some positive examples of victim engagement. However, this was not consistently evidenced across all cases, and challenges engaging with large retailers as victims were noted which South Wales Police are working to address. Early and meaningful engagement with victims remains an area for improvement. A recurring theme concerned whether diversionary courses are suitable and accessible particularly for those with additional learning needs, neurodiversity or literacy difficulties. Good practice was identified where compensation was awarded to victims, providing a tangible outcome and recognition of the harm caused. Positive use of services such as the ONE Wales Women’s and 18-25 service was highlighted in some cases, although further referral opportunities were identified in others. Referrals are quality assured by a designated team to ensure women and 18–25 year olds are referred to ONE Wales where appropriate. Several cases highlighted broader vulnerabilities and underlying needs, including domestic abuse, homelessness and complex personal circumstances. The panel also noted occasions where there was limited evidence that behaviours, such as stalking, had been considered when determining the most appropriate offence and intervention.
